Fair Use Disclaimer back The closing 3 minutes of the March 23, 1987, CBS Evening News is reproduced free of charge as a video clip under provisions of the "Fair Use" doctrine in U.S. Copyright Law. It is preserved for its historical value as an independent illustration of suspected ancient Celtic archaeoastronomical alignments and petroglyphic writing in southeastern Colorado and the Oklahoma Panhandle, a news story I first enterprised two years earlier. CBS News' awareness of these finds apparently either derived directly from my one hour KRMA TV documentary "History on the Rocks" which premiered in Denver on May 7, 1985, or derived indirectly from subsequent print media stories (see our bibliography at onter.net/scripts.html#news ) none of which acknowledged my antecedent, copyrighted broadcast. Its neutral perspective on the status of research in 1987 justifies this archival record as "Fair Use" in a scholarly context. Otherwise publicly unpreserved, our playback usage is not believed to infringe CBS' rights.--- "Fair Use" rationale by Scott Monahan, TransVision Corp., Centennial, CO, Nov. 2006 see also: Documentary Filmmakers' Statement of Best Practices in Fair Use, Center for Social Media at centerforsocialmedia.org/rock/backgrounddocs/bestpractices.pdf back |
